| 摘 要： | 中国的经济法学经过了20多年的风风雨雨，在这段岁月里，经济法的地位问题一直是学者们探讨的焦点，有肯定赞同，也有抨击否定，至今也很难说有一个大一统的意见。本文旨在把握经济法能够作为一个独立法律部门的实质要件，联合形式要件进行思考，综合地看待经济法和其它部门法的关系谈了一些粗浅的认识，以为探讨。

| Abstract: | Economic law science of China is through the trials and hardships of more than 20 years. During this years, the status question of the economic law has been focuses probed into of scholars all the time, and opinions vary. So far it is hard to tell that there is a unification . This text aims at holding the essence document that the economic law should have as an independent law department ,uniting form document, and do a discussion from the view of comparing economic law with the law of other departments synthetically. |
