| 摘 要： | 体育法的基本原则要解决体育法存在的正当性和自立性问题。它不仅可以指导体育法律规则,也可以在法律适用冲突中发挥作用。不仅可以成为体育法的条文,也应当可以解释体育法的规则。研究认为体育法的基本原则应当是具备专业性的、较高层级的,覆盖面宽,指导性强,稳定性好和可适用的基本原则。若要满足这些要求,那么这些原则同时也应当会是公认的,并具有一定传统和内涵的。本研究从体育实践和体育发展的角度以体育特殊性为标准确立体育法的基本原则。因此,在经过论证和取舍后,本研究尝试提出超越我国《体育法》文本的体育法的基本原则,即奥林匹克主义原则,公平竞赛原则,和谐体育原则。
