| 摘 要： | 建设法治国家不仅仅是制定和执行各种各样配套的法律,而且也包括更新或重建我们民族的法伦理。亲属法伦理＂爱有差等＂及义务本位性,与＂自由＂、＂平等＂、＂民主＂、＂权利＂的法治精神相冲突,亲属法伦理重视亲情、讲求人性与人本、人道的现代法治建设的价值取向相契合。在我国法治进程中,必须对亲属法伦理改造和继承.把法治理想转化为中国人的精神情感认同,这是我们实现最高层次的法律秩序—法治的必然选择。

| Abstract: | Constructing a country under the rule of law need establish and carry out various supplemental laws and update or rebuild the law ethics of our nation.There exists conflict in the relative law ethics of ＂love stratum＂ and ＂duty standard＂ and legal spirit of ＂freedom＂,＂equality＂,＂democracy＂ and ＂right＂.Relative law ethics attaches importance to relative feelings and searches the agreement of human nature and the value direction of humanity＇s modern legal construction.In the process of rule by law in our country,it is necessary to reform and inherit relative law ethics.To transform the ideal of rule by law to the approval of Chinese people＇s spirits is the inevitable option that people realize the highest level of the legal order-rule by law. |
