| 摘 要： | 特殊侦查措施主要包括技术侦查和秘密侦查这两种措施。特殊侦查措施在有效打击犯罪、提高办案的效率和质量的同时,也更容易侵犯犯罪嫌疑人权利,构成对程序正义的伤害。当前,特殊侦查措施运行中存在的主要问题是技术侦查措施的具体种类和适用程序不明确、监督救济程序不明细。特殊侦查措施的正当化需要明确特殊侦查措施适用的人权保障原则、程序法定原则、相关性原则、比例性原则,实行司法审查或令状主义,加强监督与救济程序。

| Abstract: | The special investigative measures include technical investigation and secret investigation. The specialinvestigative measures effectively combat crime, improve the efficiency and quality of case handling. Howerver, itis more easier to infringe upon the rights of criminal suspects and the procedure justice. At present, the main prob-lems existing in the operation of the special investigative measures show that specific types of technical investigationmeasure and application procedures are not clear, while supervision and relief procedures are not details. Specifica-tion for the special investigative measures, prevent misjudged criminal cases need to clear the special investigativemeasures, which applicable to the principle of human rights protection, the principle of statutory procedures, therelevant principles, the principle of proportionality, judicial review or warrant, strengthen supervision and reliefprogram. |
