| 摘 要： | 我国的精神损害赔偿制度处在发展过程中，有进一步完善的必要。我们应加强对人身权制度的理论研究，扩大精神损害赔偿的权利主体，采用财产方式和非财产方式并重的双轨制，确立刑事附带民事精神赔偿制度，完善精神损害赔偿数额的规定。

| Abstract: | In China, the moral damage system is in a procedure of developing and it is necessary to be improved. I think our country should do something as follows: strengthen the theory studying in personal right system; enlarge the subject of civil right of moral damage; adopt double-trackes system which put the property ways and the non-property ways in the same impotent position; establish moral damage system of the same important position; establish moral damage system of the civil judgment collateral to criminal proceedings; improve the stipulation about the amount of compensation in moral damage. |
