| 摘 要： | 当事人举证责任的强化与落实,必须赋予其相应的调查收集证据的手段、方法及程序保障。从两大法系有关书证收集与提供的文书提出义务制度的主要内容,可以看出我国书证收集的立法缺陷。我国应建立以大陆法系的文书提出义务制度为蓝本的书证收集制度,同时借鉴英美法系的书证强制开示程序,完善我国的审前证据交换程序。

| Abstract: | When strengthening and implementing the burden of proof in parties, it must endow with them corresponding means, methods and procedural safeguard in investigation collection evidence. Under introducing the main contents relating to documentary collection and supply of the documentation obligation system in common law and that in civil law, this article comments and analyses the legislation flaw in china, and advocates that we should sit for civil law as original version to establish our documentation obligation system . Meantime, learning the experience of mandatory discovery of document procedure in common law to perfect our pretrial proofs exchange procedure. |
