| 摘 要： | 基于我国现实经济发展水平和司法环境诸因素，新的《合同法》没有规定情势变更制度，但并不等于情势变更的问题在我们的经济活动中不会发生和存在。比照新《舍同法》解决情势变更的问题，这要视情势变更适用的条件而定。在审判实践中，可参照有关部门司法解释、判例，依据诚实信用原则和公平原则进行判定，报最高人民法院核准。为正确适用情势变更制度，应注意情势变更与不可抗力、情势变更与显失公平、情势变更与商业风险的区分。

| Abstract: | According to the economilc and legal situation in our social life, Contract Law doesn t stipulates situation's changing,but that is not to say this kind of problem doesn't exist.we need to consider how to deal with the suitable conditions in practice. We can also use other relevent department' s legal explanations and example for reference. In order to use it correctly, we should pay more attention to its relationship with irresistence , unfairness and business risk. |
