| 摘 要： | 通过对中、美国家体育主管部门、欧洲体育协会等在运动员无形资产开发权上的权限比较,发现：我国的国家队队员没有对自己＂球员特征＂的使用权;而美国在使用＂球员特征＂时受到了诸多限制,美国国家队员拥有自己无形资产的主动权和话语权;欧洲国家的体育组织、协会在运动员加入各组织后仍给予运动员一定的行使个人形象权的自由。中国和西方的体育是截然不同的体制,举国体制下我国运动员的无形资产价值中有国家培养的成分,国家有权使用,但由于无形资产有受主体控制的特性,运动员的气质、内涵、形象在无形资产的开发中起了很重要的作用,所以无形资产也有运动员的投入,国家禁止运动员以任何形式使用或许可第三方使用自己＂球员特征＂的这种行为,是一种以行政手段剥夺了民事权力的侵权行为。

| Abstract: | Through analysis on the permission about the development rights of intangible assets of athletes among China administrative departments on physical education, America administrative departments on physical education and the European sports association, we found that ： China national team athletes do not have the rights to use their own player features ; America national team athletes have discourse power and initiative on their own intangible assets ; sports organi- zation and sports association of European countries allow athletes to use personal images after they join the organization. China and west countries hold different sports systems. In China, state has the rights to use intangible assets of athletes as they are trained by the state. However, considering the specific eharactefistics of intangible assets to be controlled by athletes （ e. g. , temperament, connotation and image ） , athletes play an important role in the formation of intangible assets. Therefore, the behavior that athletes are prohibited from using their player features by the state is an infringement to the civil right through administrative means. |
