| 摘 要： | 社会保障功能的实现需要法律制度的支持。而社会保障法作为社会法的核心内容，同时兼有经济法的一些属性。因此对社会保障法律制度的构建应体现出社会法与经济法在功能上的相互配合，具体的社会保障制度应由社会法来进行规范，而如何保证社会保障功能的实现．则应由经济法加以规范，由财政作为社会保障的基础实现这一目标。

| Abstract: | The realization of public protection needs the relative law institutions; so that public insurance law, as the core of social law has many characters of economic law; therefore, the building of legal system about social public protection should reflect the cooperative function on the law of economic and society. The concrete public protection institution should be regulated by social law, while the effect about how to realize that functions needs to be prescribed by economic law and the national finance as the foundation of the public protection to ensure this target＇s coming true. |
