| 摘 要： | 我国应确立沉默权制度，是基于我国对无罪推定原则的实行，对抑制刑讯逼供的需要，以及我国刑事诉讼法制与国际接轨等一系列现实情况的要求，确立我国的沉默权制度，在内容上应重点围绕案件侦查，审查起诉，法庭审理这三个阶段和其他有关主要问题。

| Abstract: | The silence right system should be established in our country. The establishment should be based on the practice of not guilty deduction principle in our country and a series of present facts, such as to restrain extorting confessions by touture, to make ourcriminal procedure legal system combine with the international ones. For the purpose of establishment of the silence right system in our country,the contents should specially put on three stages as case scouting, investagting and suing, trying in the court and other concerned main questions. |
