| 摘 要： | 法治社会,是指以市场经济作为其活动空间的自治自律的市民主体通过契约,理性缔结各种社会关系从而实现应有权利和利益的一种社会形态,法治社会与非法治社会最重要的区别在于经济交往方式及其规范模式方面的差异。宪政国家是指为保障公民的自由权免受政府及他人的侵蚀,通过并依据宪法对政治权力进行有效限制与规范的国家。法治社会是宪政国家的基础,法治社会与宪政国家通过公法与私法适度渗透来实现良性互动,确立相辅相成的关系模式,正是法治社会与宪政国家的互动构成了宪政。

| Abstract: | The legal system society is one kind of form of society in which,by the market economy took its active space,the autonomous autonomy residential main body bring about his rights and benefits through the contract rationality to conclude each kind of society relationships.The difference of government by law society and non-the legal system society lies in the economical contact way and its standard pattern aspect.Constitutional government country refers that for the sake of ensure citizens' free right not to be aggrieved by government and other people,via and base on the constitution effective limiting and standard the political authority.The legal system society is the basic of constitutional government country,both realize well-ordered interaction,establish the complements one another relational pattern,so the interaction forms constitutional government. |
