| 摘 要： | 随着2012年以来《民事诉讼法》与《消费者权益保护法》新增加了消费公益诉讼,我国已形成了多元化的消费者诉讼形态.但现有模式中的个人诉讼、代表人诉讼、公益诉讼都还存在些许问题,立法也未能明晰其相互间的区别适用情形.因此,我国应借鉴域外立法,立足于实践,对消费者诉讼形态进行类型化分析,以使现有的消费者诉讼能够多元化、全方位地保障消费者权益.

| Abstract: | Consumer rights disputes with ordinary civil disputes do not have the characteristics of the modern era consumer litigation has increasingly become an important lawsuit type. With the ＂Civil Procedure Law＂ and ＂Consumer Protection Law＂ increased the consumption of public interest litigation in 2012, China has formed a diversified form of consumer litigation. However, the existing pattern of individual actions, representative action, there is little public interest litigation are issues, legislation also applies to the case of its failure to clarify the difference between them. Therefore, we should learn extraterritorial legislation, to analyze the type of consumer litigation morphology based on our practice, in order to diversify the existing consumer litigation and to protect consumer rights comprehensively. |
