| 摘 要： | 建造中船舶抵押权登记兼具公法性质和私法性质,并且应以所有权登记作为基础或与所有权登记同时进行。建造中船舶抵押权如果没有进行登记,则不得对抗的"第三人"应为其他享有船舶物权的人。对于已经进行抵押登记的在建船舶,若船舶建造完毕时,该抵押权仍然存在,则船舶登记机关应当将该抵押权按原抵押登记日期记载在船舶所有权登记证书之上。目前,建造中船舶抵押权登记所涉及的申请、审查和登记等方面均存在一定的问题,应对整个登记程序予以完善。

| Abstract: | Based on property registration ,mortgage registration on vessels under construction is of both public law and private law nature .Mortgage on vessels under construction cannot be against other people w ho enjoy property rights on the vessel under construction .Vessel registration authority shall record the mortgage on vessel under construction to the registration certificate of vessel property registration if the mortgage is still effective as the vesselis completely built .At present ,there are certain problems existing in application ,review and registration steps and the w hole registration procedure shall be restructured . |
