| 摘 要： | 现代生活中,我们随时可能会与侵权行为不期而遇。而在侵权法中,过失侵权占有较大的比重。过失的判断标准就成为归责的一个重要问题。英美侵权法对此采用的是＂合理人标准＂,即以一个理性的通情达理的人作为行为的参照标准。在我国侵权法上,对过失侵权行为的认定仍是空白,因此这一标准对我国侵权法的构建非常具有参考价值。

| Abstract: | Nowadays,we can meet tortuous acts everywhere,and negligence is a majority part in tort law.Then the standard to judge negligence become a very important issue in liability system."The reasonable person standard" is adopted in Anglo-American Law.But this issue still blank in our country tort law system.So We can take it as reference for the construction of our country tort law. |
