| 摘 要： | 教师均衡配置是义务教育均衡发展的瓶颈。我国教育立法的局限性与以效率为导向的基础教育政策导致义务教育的非均衡发展。《教师法》对于教师作为履行教育教学职责专业人员的法律地位和以此为基点设计的教师资格制度、职务制度、聘任制度,不能从根本上遏制当前义务教育教师非均衡发展的态势。惟有将义务教育教师定位为国家公务员,确立政府与教师的行政法律关系,各级政府所作的教师均衡配置的行政行为才有法律依据。
