| 摘 要： | 开展行政复议委员会试点工作,对于依法行政、保障行政争议解决的公正性具有重大的意义,集中、独立是行政复议委员会制度设立的基本方向。在当前的试点工作中,复议委员会人员组成、回避、职务保障等相关的保证公正的制度存在一些问题。对此,应当围绕制度的核心取向,完善人员组成及回避制度,建立委员言论豁免、职务活动保障制度,扩大当事人的参与权,行政复议委员会制度从试点到实施,才能体现其重大的制度意义。

| Abstract: | To carry out the administrative reconsideration committee experimental work is of great significance for administrative according to law and impartiality of the administrative dispute resolution.Concentration and independence is the basic orientation of this system.There are some problems in the composition of the committee,avoidance,official guarantee and other related systems.Accordingly,some systems such as composition of committee,speech exemption and parties participation should be built or improved. |
