| 摘 要： | 本文从刑法的角度，通过对驰名商标犯罪社会危害性、刑法对驰名商标的保护功能、驰名商标刑法保护的国际发展趋势等方面的分析，系统论述了驰名商标刑法保护的必要性，针对我国驰名商标刑法保护的现状，提出了我国驰名商标刑法保护尚存的一系列问题：没有从刑法角度制裁驰名商标淡化和反向假冒，服务商标、未注册商标都没有相应的刑法保护机制，刑法对商标权的保护量刑过于简单，本文对这些问题从理论和实践层面进行了若干思考。

| Abstract: | The article has a detailed discussion of criminal law protection of well -known trademark through analysis of social harness for its torts, protection function and international trend. It first discusses law protection of well - know trademark, and then deals with a series of problems in terms of criminal law sanction to the dilution and reversed imitation of well - known trademark, the absence of related protecting mechanism of criminal law to serving trademark and unregistered trademark, etc. Comments and suggests are made that are considered relevant to its improvement. |
