| 摘 要： | 契约内含着自由的成分,契约自由是契约的逻辑延伸,也是契约伦理的核心和灵魂。契约自由是契约得以订立的根本前提,订立契约的双方必须是平等的、自由的,契约活动是一种自主自愿的活动;同时,自由意味着责任,总是会受到一定的限制和约束。契约自由原则的伦理内涵包括：自愿合意原则、自由与道德责任相结合原则、契约自由的有限性原则。
