| 摘 要： | 在以数额为核心内容的经济犯罪中，往往存在个人犯罪与单位犯罪定罪量刑标准不一致的情况。由此引出在单位与自然人共同犯罪的场合，以个人标准为准还是以单位的标准为准的问题，这是司法实践中的一个难点。对此，理论界争议也较多。本文在分析各种观点的基础上对该问题进行了探讨，并就法律相关规定的适当性进行了分析。

| Abstract: | Some crimes regulate different amount standards between unit crime and individual crime in the economic crime. The result is that how to choose the amount standard when there is a joint offense of unit and individual. Many scholars have researched this problem and have brought up their opinions. The article wants to tackle this problem at the basis of these opinions. By the way, the article also has an exploration of the judicial interpretation about the different amount standards. |
