| 摘 要： | 司法不作为是指司法机关及其工作人员依法负有履行义务且有履行义务的可能性，但却在程序上不为任何行为的司法活动样态．然而《国家赔偿法》的赔偿范围并不包括此类侵权行为。沿着我国各种诉讼程序的运作轨迹可以发现，司法不作为主要表现为程序启动状态的不作为、程序过程中的不作为及程序未终了的不作为等形式。

| Abstract: | Judicial omission refers to the form of judicial activity that judicial organ and its staffs have their duty and the possibility to fulfill it,but do nothing procedurally.However,the National Compensation Law hasn't included this tort in its scope of compensation.It can be discovered along the track of the operation of various forms of judicial procedures that judicial omission mainly has the forms of the program initiation omission and program process omission. |
