| 摘 要： | 附随义务理论首先产生在德国的司法实践中 ,不同于约定义务 ,是由法律所直接规定的 ,是现代合同法在诚实信用原则基础上对合同义务的扩张。依据产生阶段的不同可以分为先合同义务、合同履行中的附随义务和后合同义务三种。附随义务的类型法律有明确的规定。违反附随义务所应承担的法律责任不同于违约责任和侵权责任 ,而是违反合同义务的责任

| Abstract: | The subordination obligation theory arose from the practise of Jubicatory of German at first,which is diffrent from promised obligation It is the expand of contract obligation based on the Bona Fide Doctrine in modern contract laws,and regulated directly by the law.According to the diffrence among their appearance,it falls into precontractual obligation aftercontractual obligation and the subordineted obligation in contract performing.There is a clear defination for the tyres of subordinated obligation.The legal liability which should be taken while violating the subordinated obligation is diffrent from the shortened to breach of contract and from the liability of torts,which is the liability of violate contractual obligation. |
