| 摘 要： | 城镇化的推进和商品房价格的持续增长催生了小产权房。国家住房建设部近年来一再出台政策遏制小产权房的交易,提示人们购买小产权房的高风险,但是因其价格优势,小产权房成为了城市中低收入者的无奈之选。小产权房的非法性而导致的各种社会问题使小产权房成为近年来的社会热点。分析小产权房产生原因的基础上,提出两点解决意见:出台保护居民居住权的相关法律;完善国家土地管理、使用、分配等方面的法律法规。

| Abstract: | The development of urbanization and the sustained rise of commercial housing prices give rise to houses with limited property rights. While the Housing Construction Department of our country has issued a lot of policies to restrain the trade of houses with limited property rights for the past few years, reminding people of the high risk of buying houses with limited property rights, they still become the helpless choice of the medium-and-low income group due to the price advantage. The illegality of houses with limited property right gives rise to a lot of social problems ,which make it a social hot spot. This paper analyzes the causes of houses with limited property right from the perspective of economic law and puts forward to two suggestions： to issue related laws to protect people＇ s right of habitation; to improve laws and regulations of our country in the aspects of land management,use,distribution and so on. |
