| 摘 要： | 票据权利善意取得制度意在牺牲原权利人的利益来保护善意持票人的利益,以保护交易的安全性和流通性,各国立法中大多规定了票据权利善意取得制度,其构成要件主要有四个.为了在实践中更好地应用此制度,我们必须明确这些构成要件的内涵,解决其中包含的特殊问题.

| Abstract: | The system of Bill Right obtained by Bona Fide Possession is a very important system,it is intention to protecting the right of endorses in goodwill,endorsee in goodwill has the final right to gain the rights of bill,and the true beneficiary,can't claim for recovery of compensation.Its aim of legislation is protecting deal safe in the final dealing.There are four elements which constitute the concept of Bona Fide possession of Bill Right.In order to make good use of the system,it is necessary to study the Ingredients of Bona Fide Possession of Bill Rights more definitude,and settle the special issue of it. |
