| 摘 要： | 在中国宪法的发展问题上，越来越多的学者主张一种释宪主义的发展观，主张采用微观的、渐进的宪法解释模式来弥补宪法条文与社会现实之间的鸿沟，以维护宪法的稳定性与权威性。但是，从对宪法的实质意义上的分类以及对中国宪法的现实定位来看，现行宪法还不具有进行宪法解释的充足条件，因而单纯的宪法解释的发展进路对于中国的宪政建设来说可能意义甚微。

| Abstract: | On the development of Chinese constitution, more and more scholars hold an interpretational view, claiming that the gaps between constitutional rules and social realities can be offset by the interpretation model in order to keep the stability and authority of the constitution. But in view of classification of the constitution in essential sense and in realistic orientation of Chinese constitution, the current constitution does not possess sufficient conditions for constitutional interpretation, so the development buildup in pure constitutional interpretation will probably contribute little in the construction of Chinese constitution. |
