| 摘 要： | 国际经济法的每一项制度或具体实践都能体现其基本原则,其中公平互利原则作为国际经济法的基本原则之一主要体现了国际经济法理论的基本价值取向,并在国际经济活动中能够提供正确的方向指导。然而学界对于公平互利原则一直存在争议,部分学者认为国际经济法应该适用平等互利原则,前者强调公平,后者强调平等。在具体国际经济交往活动中,公平互利比平等互利更具有普适价值,公平互利原则作为国际经济法的基本原则更合适。

| Abstract: | The basic principles of the international economic law find expression in each of its specifications and practices. The principle of fairness and mutual benefit,as one of the basic principles of international economic law reflects the basic value orientation of the theory of international economic law and can provide a correct driection for international economic activities. However,the principle of fairness and mutual benefit has been under controversy among international economic law circles,and some scholars think that the principle of equality and mutual benefit should be applied. The former emphasizes fairness while the latter emphasizes equality. In the international economic activities,the principle of fairness and mutual benefit is more applicable than the value of equality and mutual benefit so that the former is more suitable as a basic principle of international economic law. |
