| 摘 要： | 国家赔偿法经过修改完善,基本解决了原国家赔偿法存在的赔偿门槛高、标准低、范围窄、程序乱等诸多问题。其修改亮点主要表现在以下几个方面：国家赔偿归责原则多元化,拓宽了国家赔偿的范围;完善了国家赔偿程序,畅通了赔偿渠道;明确举证责任规则,完善了赔偿制度;提高了赔偿标准,明确精神损害赔偿;规定赔偿金由财政部门统一支付,保障了赔偿费用的到位。不足之处在于赔偿范围有待进一步扩大,未将受害人的间接损失纳入赔偿范围;没有规定行政不作为造成损害的赔偿责任;没有规定公有公共设施致害的赔偿责任;未建立与国家赔偿制度相衔接的国家补偿制度。

| Abstract: | After modification,problems such as high reparation threshold,low reparation standard,narrow reparation range,and disordered procedure existing in the State Compensation Law have been basically solved.Its main modifications lie in the following aspects： first,expanding the coverage of compensation by diversifying reparation imputation;second,expediting the reparation channel by perfecting national compensation procedures;third,perfecting compensation system by clarifying onus responsibility regulations;fourth,raising compensation standards and defining mental damage compensation;fifth,stipulating that the reparation be paid by financial department to guarantee the payment of damages.Its main deficiency proves to be： the extent of compensation remains to be expanded and the indirect losses of the aggrieved party are not brought into compensation;the remedy for administrative omission and injury caused by public facilities are not stipulated;national recompense system is not established to link up with the state compensation system. |
