| 摘 要： | 现代民主法治社会,权力须以权利为出发点与归宿.不论是权力对权利的积极保护,还是权力对权利的消极限制,皆以人权保障为首要价值.政府基于对社会连带关系、公共利益、实质人权保障的合理考量,获得限制公民基本权利的正当性,然此种限制亦必须遵循一系列严格的合法性要求,惟其如此,方能实现民主法治与人权保障的和谐统一.
