| 摘 要： | 债权相对性原则是古典契约法的基石，整个司法体系都在此基础上构建。然而，随着社会经济的发展，债的效力呈现扩张的趋势，债的相对性也得到了突破。本文从分析债权相对性的内涵人手，具体探究了债权相对性的各种突破和扩张之情形，提出债权相对性的突破只是债的相对性的例外，其目的是为了更好地实现社会公正、达成利益平衡，而不是否定或推翻债的相对性，更不能因此而否认债权与物权的区分实益。

| Abstract: | The principle of relativity of debt is the cornerstone of classical contract laws on which the whole system of private laws are established. However, with the development of social economy, the effect of debt is expanding, and the relativity of debt is broken. This article begins by analysing the essence of relativity of debt; discusses the different kinds of breakthrough; points out that the breakthrough is just the exception to relativity of debt, which aim is to still better realize social justice, achieve benefit balance, but not to negate or overthrow relativity of debt, yet not to deny the importance of distinguishment between creditor right and real right. |
