| 摘 要： | 死刑是一种最严厉的刑罚．从世界范围看．废除死刑已成为不可逆转的潮流。根据中国的具体情况厦社会发展的现实需要．中国刑法还不能废除死刑，但应顺应时代和潮流的发展。不断完善中国的死刑制度，严格限制死刑的适用．体现慎刑的政策。
