| 摘 要： | ＂规范何以可能＂是规范研究的最基本的问题。对这一问题的研究可分为两种不同的进路或模式,一种是合理性意义上的,可表示为＂必然→规范→自由＂;一种是发生学意义上的,可表示为＂自由→规范→必然＂。两种模式或进路之间的冲突和矛盾只是表面上的,实质上,它们共同探讨了规范的可能性与规范研究的必要性。这一点可通过规范、自由、必然三者之间的关系来说明。

| Abstract: | How norms can be possible is the basic question of norm study. There are two ways of studying this question： （ 1 ） sense of rationality, which can be shown as ＂ inevitability norms freedom＂, （2） sense of ontogeny, which can be shown as ＂freedom norms inevitability＂. The conflicts of the ways or models are just obvious, and they can be explained through the relations among norms, freedom and inevitability. In fact, they proble into the possibility of norms and necessity of norms research together. |
