| 摘 要： | 引渡制度是一项国际司法协助的重要制度,也是国家有效行使管辖权和制裁犯罪的重要保障.在国际法上,国家没有必须引渡的义务,引渡的法律依据应为含引渡条款的国际条约、国际公约以及相关国内立法.<中华人民共和国引渡法>的颁布施行,为中国国内有关机关处理中外之间的引渡问题提供了重要的法律依据.

| Abstract: | The system of extradition is an important one with the help of international judicature. It is also an important guarantee for a nation to carry out jurisdication and punish criminals. In international law , a nation has no obligation for extradition. The law basis of extradition should be international treaty and pact involving extradition provisions and interrelated inner legislation. The issuing and carrying of Extradition Law of the People's Republic of China provide important legal basis for the related organizations in China to treat extradition between China and other countries. |
