| 摘 要： | 在现代社会中，采用格式条款订立合同，在某些行业广泛使用，但格式条款的拟定往往为了自身利益，损害相对人的利益，为规范其运行和发展，我国《合同法》对其作了明确规定。本从格式条款的概念和特征入手，分析其不足，探讨《合同法》对其规制的手段。
