| 摘 要： | 行政指导是现代市场经济和合作、协商的民主精神发展的产物,是发展民主政治和保证社会各项事业持续健康稳定发展的重要因子。由于行政指导的相关研究较为落后和立法层面的缺陷,其在制度设计和运行实践中存在诸多现实困境并制约着行政指导目的的顺利实现。软法之治的兴起、软法机制的健全,可以为行政指导的完善提供一种新的思维面向。
