| 摘 要： | 刑法理论中因果关系条件说存在逻辑上的不足，不仅包含必要条件，还应包含充分条件和充要条件。建立在条件说基础上的相当因果关系中断理论有违因果关系客观性之嫌，在立论上有值得进一步探讨的空间。
