| 摘 要： | 民事检察监督的作用是维护司法公正和社会公益。但在实践中，民事法律监督的这一法律地位还未真正确立，检察机关处于被动的地位。造成这一状况除立法上的原因外，未建立民事检察监督科学的评价标准也是重要因素。在这种情况下，除完善法律的可操作性外，还应对民事检察监督的目标和价值取向作相应的调整。

| Abstract: | Civil prosecutorial supervision has the function of safeguarding the judicial justness and social benefit. In fact , this function has not been really established and the procuratorial organizations are in the passive positions. Besides legislation reasons, the cause of this phenomenon also includes not establishing the scientific evaluation standards of civil procuratorial supervision . We should improve the maneuverability of laws, as well as adjusting the aim and value orientation of civil procuratorial supervision. |
