| 摘 要： | 刑罚本质问题是刑法理论的最基本的问题之一。方孔先生认为刑罚的本质是动物性,这种理解无疑是肤浅的,对刑罚理论的发展也是极为有害的。只有从人性角度出发,分析报应刑论和目的性论的分歧和利弊,才能真正得出科学合理的结论,即刑罚的本质是并合主义论。

| Abstract: | Penalty nature is one of fundamental problems of criminal theory.Mr.Fang Kong considers it as animal nature.This theory is undoubtedly superficial and deeply harmful to the development of the criminal theory.Only by analyzing the disadvantages and differences of retribution theory and purpose theory of punishment in terms of humanity,can the scientific and reasonable conclusion be achieved.The penalty nature is the theory of merger. |
