| 摘 要： | 近年来，由于生态环境日趋恶化，我国政府对森林和林木的保护力度不断加强，有关的立法和司法解释日臻完善，但关于滥伐林木罪等涉及林木犯罪的基础理论研究却相对薄弱、滞后，尤其是经常处理滥伐林木犯罪的森林公安对滥伐林木犯罪的犯罪构成理论几乎没有研究。文章着力于我国集体林权改革背景下，就刑法规定的滥伐林木罪，从我国现行的刑法犯罪构成理论角度进行分解、重构，进而提出笔者的观点。
