| 摘 要： | 我国现行立法关于胎儿权利的规定仅在继承法中有所规定,在《德国民法典》以及我国台湾地区《民法典》中都有对胎儿利益的保护务款。随着新生物技术和现代医学技术的发展以及社会政策的变化,未出生胎儿作为被法律遗忘的弱势群体,有必要重新确认其在民法中的法律地位。本文就未出生胎儿的法律定位、未出生胎儿的民事权利范围以及未出生胎儿的损害赔偿请求权三个方面进行论述,以期对实务有所裨益并作引玉之砖。

| Abstract: | To some extent, our country's current legislative provision on foetus' right is only the regulation in the inheritance law, "The Civil Code of Germany" in Germany and "the People's Codes" in Taiwan, China have stress on the protection of foetus' rights. Along with the development of new biotechnology, up-todate medical technology, andthe changes of social policy, it is high time to confirm the legal status in the civil law again as foetus fall into a weak colony of people. This paper discusses the following 3 aspects: foetus's legal position, civil rights, and compensations of damages. Thus, it is hoped the proposals here might arouse the attentions of other experts. |
