| 摘 要： | 全国人大十届二次会议修宪，将“保障人权”概念写入宪法，具有极为重要的现实与历史意义。就人权保障与舆论监督的关系而言，舆论监督既是人权的基本内容，又是人权获得保障的方式。舆论监督需要人权作基础，人权保障需要舆论作监督，二者相辅相成，不可分离。舆论监督是人权运用的形式，人权保障是舆论监督的目的。

| Abstract: | In the latest People's Congress, Chinese Constitution is modeifed. The idea of human rights guarantee is added to the Constitution. This is an event of historical importance. Considering the relationship between the supervision of public opinions and the guarantee of human rights, the supervision of public opinions is both the main content of the guarantee of human rights and the approach to human rights guarantee. The supervision should have the basis of human rights and the guarantee of human rights needs supervision, which means that these two are interrelated. |
