| 摘 要： | 我国在处理中小学生伤害事故中学校和教师的责任分担时,存在专门立法层级低且适用依据不完善,中小学校承担补充责任有争议,监护人过失视为被侵权学生过失,受害学生自杀、自残时学校责任确定不清等问题。应确立符合我国实际的中小学生伤害事故的责任分担规则,以正确处理中小学校的替代责任和过错教师的最终责任、中小学校的补充责任、中小学校因被侵权学生过错的分担责任,以及第三人、学校和被侵权学生及其监护人的三方责任分担问题。
