| 摘 要： | 稀缺资源只有在统一市场才可获致最优配置,大国中政治性分权与经济性统一的制度悖论必将产生市场分割问题,财政联邦制、司法调节等难以解决此种顽疾.自由流动规则、竞争规则是克服市场分割、维护市场统一之基本规范.中央应从战略高度重视两类规则之构造,在宪法中增设自由流动条款；扩大竞争规则适用于政府行为的范围.
