| 摘 要： | 社会连带理论认为，随着有机连带关系取代机械连带关系，合作性法律将替代压制性法律。该理论与刑法谦抑思想具有内在一致性。合作性法律注重鼓励法律所欲的行为，充分有效的非刑法保护应得到优先考虑。见义勇为应被视作规制见危不助的反面切入。目前我国保障、鼓励见义勇为的法制并未得到充足利用与完善。与其强调见危不助犯罪化，不如优先选择并发挥非刑事法律手段在鼓励、保障见义勇为、从反面遏制见危不助的作用。

| Abstract: | There exists inherent consistency between criminal law being modest and self-restrained and the fact that oppressive law shrinks in modern society.Cooperative law corresponding to organic social implicative relationship pays more attention to encouraging actions wanted by law which is more effective than taking advantage only of oppressive law.Non-criminal legal measures should be taken prior to criminal ones to regulate actions of not giving help with others' peril. |
