| 摘 要： | 尽管现行法律对土地承包经营权抵押设定种种限制,但是土地承包经营权抵押已经成为农民融资的重要方式之一.为了更好地促进农村经济发展,提高农民的生活水平,我国立法应明确规定土地承包经营权可以抵押,并设计相应的抵押配套制度,对农村土地承包经营权抵押金融组织模式进行创新.
