| 摘 要： | 当代中国"新闻审判"现象的出现有其特殊的背景,从结构功能主义角度分析,它是传播的社会协调功能干预法的社会协调功能的结果,其本质是舆论力量的权力化,影响了法的权力的正常履行。解决这一问题,一是要通过法律使传媒活动规范化,二是要通过传播的教导完善法的执行环境。

| Abstract: | The "trial by the news media" phenomenon in the contemporary China has its special background. Viewed from the angle of structural functionalism, it is the result of the interference of the social coordinating role of the media with the justice by law. The nature of the phenomenon is conversion of the media into a kind of judicial power which intervenes the normal administration of law. The solution of the problem lies in the normalization of the medium activities by means of law and the improvement of the atmosphere of law administration through the enlightenment of the media. |
