| 摘 要： | 死刑存废之争由来已久,立论点有十余种之多.死刑存置论者极力从死刑的威慑力来维护死刑的正当性,而死刑废止论者则以人权主义否定死刑的正当性.死刑的正当与否应有一个明确的结论.

People who persist in the opinion of death penalty think that it has a deterrent force, while people who persist in stopping death penalty deny the justice of death penalty with humanism.
