| 摘 要： | 通常,我们认为公权存在的目的是为了保障私权,但是因为公权代表的是公共利益,因此私权又要绝对地服从公权。在社会发展过程中,公权与私权发生矛盾的情形处处可见,私权主体呼吁并要求立法采取一些行动对公权进行限制,于是很多人就开始质疑:对公权的限制是否会削弱公权对私权的保障?对此,笔者持否定态度。文章从两个方面论证了公权对私权作用,更确切来说,这种作用是一种服务的作用。这种作用只有在一定范围内才能被恰当地发挥出来,而非不加限制的一味扩大。

| Abstract: | Usually, we think the purpose of existence of public rights is to guarantee a proprietary, but because public rights are representatives of public interests, proprietary must absolutely obey the public rights. In the social development, public rights conflict with private rights everywhere, the situation calls for privacy subject and requests legislation to take some actions to limit publicrights, so many people begin to question： wliether the restrictions to public rights will weaken the guarantee of public rights to the proprietary, while the paper takes a negative attitude. This article demonstrates the function of public rights to proprietary role from the two ways, and more exactly, this kind of action is a service role. This function can he properly play an important role only within a certain range instead of blindly expanding restrictions. |
