| 摘 要： | 近一二十年来,对民办学校来说,产权问题一直是极具争议并且悬而未置的问题。当前在民办学校产权问题上究竟存在着哪些争论?这些争论的焦点是什么?为什么会有这么多的争论?我国相关的法律法规对这些问题是如何规定的?进而又应该如何通过法律制度的完善解决这些产权问题?本文试图从产权概念的理解出发,然后综合现实案例、理论研究和法律法规等对以上问题进行分析。

| Abstract: | The issues on property rights of non-governmental school(NGS) have been disputed for two decades.Which key issues are disputed? Why are there so many disputes? What are the laws on property rights in China? And how should China improve the related laws to solve the problem on property rights of NGS? This paper discusses a lot of views by quoting cases,literatures and laws.Then according to that,whether the NGS have the purpose of for-profit or not-for-profit,two types of for-profit NGS and non-profit NGS should be classified clearly. |
