| 摘 要： | 正当防卫制度是刑法中的一个重要内容,由于过去立法上存在一些问题,制约了正当防卫制度的有效实施,新刑法对此做了一些必要的修改。文章在比较新旧刑法关于正当防卫制度规定上的差异的基础上,分析了修改的意义,探讨了如何准确地理解新规定,并对新刑法的修改提出了相应的建议。

| Abstract: | The justifiable defense system is a very important part of the criminal law.There used to be some problems restricting its effective practice so there are some necessary corrections in the new law.Based on the comparison between the former law and the revised one,the paper discussed how to understand the new regulation with suggestions for further modification. |
