| 摘 要： | 体育教学中,学生伤害事故的发生是一种较普遍的现象。从法律视角,运用材料分析、实证分析、对比分析等研究方法,论述了体育教学中学生伤害事故所导致的法律责任的性质,旨在能够更好地保障学生合法人身权益的实现和维护学校正常的教学工作秩序。最后,认为体育教学中学生伤害事故不仅可构成侵权责任,亦可产生违约责任。体育教学中,学生伤害事故的发生是一种较普遍的现象。从法律视角,运用材料分析、实证分析、对比分析等研究方法,论述了体育教学中学生伤害事故所导致的法律责任的性质,旨在能够更好地保障学生合法人身权益的实现和维护学校正常的教学工作秩序。最后,认为体育教学中学生伤害事故不仅可构成侵权责任,亦可产生违约责任。

| Abstract: | In PE teaching,the occurrence of harm accidents becomes a widespread phenomenon.This article discussed deeply the nature of responsibility about harm accidents of students in PE teaching. From the angle of laws, making use of material, demonstration, comparative analysis and so on. Its purpose lies in safeguarding to realize the students' lawful personal rights and interests that the accidents of students in PE teaching of school. Finally, the article showed that the accidents of students in PE teaching can not only constitute liability for tort, but also cause liability for violating a treaty. |
