| 摘 要： | 高校应该实行依法治校，依法对大学生进行管理。在教育教学过程中，按照国家宪法和法律的基本原则和精神开展各种管理活动。明确高校的义务，限制高校的权力，不侵犯学生的合法权利，把确立学生权利主体地位作为依法治校的基本要求。同时，大学生也应提高权利主体意识和自律意识。这样才能平衡协调好高校管理权与学生权利之间的矛盾，促进高校健康稳定的发展。

| Abstract: | In order to manage school by law, The university ought to manage students by law, and build up the consciousness of serve students. In course of teaching, university runs all kinds of management activity according to the basic principle of constitution and law. The basic request of managing school by law includes specifying the obligations of school, restricting the powers of school, protecting students＇ legitimate rights and establishing students＇ legal status of subject. Meanwhile, university students should build up consciousness of right subject and self-discipline. In this way, we can balance the conflict between university＇s management power and students＇ rights appropriately and advance health and sustainable development of university. |
